Introduction#

These Terms of Service ("Terms") govern your access to and use of the Ticket King Discord bot ("Bot"), the website at https://ticketking.xyz ("Website"), the dashboard, and all related services (collectively, the "Service") provided by Ticket King ("we," "us," or "our"), operated in the United States. These Terms apply to all users of the Service, including Discord server administrators who install the Bot and end users who interact with ticket channels managed by the Bot.

1. Acceptance of Terms#

By accessing the Website, adding the Bot to a Discord server, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are adding the Bot to a Discord server as an administrator, you represent that you have the authority to bind the server and its members to these Terms to the extent permitted by law.

If you do not agree to these Terms, you must not use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

Age Requirement: You must meet the minimum age requirements set by Discord's Terms of Service to use the Service. For clarity, this means you must be at least 13 years of age, or the minimum age of digital consent in your jurisdiction if higher (such as 16 in certain EU member states). By using the Service, you represent that you meet these age requirements. We rely on Discord's age verification and Terms of Service to enforce these thresholds.

2. Description of Service#

Ticket King is a Discord bot that provides ticket management functionality for Discord servers. The Service includes creating and managing support ticket channels; collecting, processing, and persistently storing ticket messages (including message content, metadata, and uploaded files); displaying ticket messages in real time to authorized server staff through the web dashboard while tickets are open; generating and storing ticket transcripts after tickets are closed; providing a web-based dashboard for server configuration, ticket management, and transcript viewing; and displaying ticket transcripts on the Website. The Service may also include premium features available through paid subscriptions.

3. Service Availability#

The Service is provided on an "as available" basis. We do not guarantee any specific level of uptime, availability, or performance. We do not offer a Service Level Agreement (SLA) and make no commitments regarding uninterrupted or error-free operation of the Service. Scheduled or unscheduled maintenance, updates, and system changes may temporarily affect the availability of the Service.

No Data Loss Guarantee: While we perform daily backups on a 30-day rotation cycle, we do not guarantee against data loss. Backup failures, corruption, or other unforeseen circumstances may result in the loss of data, including ticket transcripts, server configurations, and uploaded files. You acknowledge that the Service should not be relied upon as a sole repository for critical data and that you are responsible for maintaining your own independent records where data preservation is essential.

Third-Party Dependencies: The Service depends on third-party platforms and infrastructure, including Discord, cloud hosting providers, content delivery networks, and object storage providers. We are not responsible for any disruption, degradation, or limitation of the Service caused by changes to, outages of, or discontinuation of any third-party platform, including the Discord API or Discord's bot platform.

4. Server Administrator Terms#

If you add the Bot to a Discord server as an administrator, you agree to the following:

  • You acknowledge that Ticket King will process message content, metadata, and file attachments in designated ticket channels in order to provide transcript functionality.
  • You are responsible for informing your server members that Ticket King is active and that messages and attachments sent in ticket channels will be stored, may be viewable in real time by authorized server staff through the web dashboard while tickets are open, and will be compiled into transcripts that are viewable on the Website by the ticket creator and authorized server staff after ticket closure.
  • You acknowledge that images, videos, and other media posted in ticket channels may be transmitted to, processed by, and stored on third-party infrastructure, including our object storage and content delivery providers, when your server has features enabled that require such processing (such as image and attachment storage for transcripts). Not all servers have these features enabled; third-party processing of ticket channel media occurs only when the server's configuration requires it. You are responsible for informing your server members that media they post in ticket channels may be subject to third-party processing and storage.
  • You acknowledge that images uploaded directly through the Website dashboard (such as custom bot avatars and banners) are transmitted to, processed by, and stored on third-party infrastructure, including our object storage and content delivery providers. These third-party providers process uploaded content on our behalf under data processing agreements. By uploading images, you confirm that you have the right to upload them and that they comply with these Terms.
  • You may configure transcript settings, including access permissions and channel designations, through the dashboard.
  • You may request deletion of all transcript data associated with your server by contacting us at [email protected] or through the dashboard where available.
  • You are responsible for ensuring that your use of Ticket King complies with applicable laws in your jurisdiction, including obtaining any consents from your community members that may be required under applicable data protection laws.
  • You may remove the Bot from your server at any time. Removal will stop all new data collection for your server. There are no penalties, fees, or negative consequences for removing the Bot.
  • For information about your data processing obligations and Ticket King's role as a data processor, please review our Data Processing Agreement.
  • The phrase "authorized server staff" in these Terms refers only to Discord users to whom you, as the server administrator, have granted ticket access within your own Discord server. It does not include staff or moderators of the Ticket King official support Discord server, who have no access to your server's tickets, transcripts, messages, configuration, or any other data.

5. End User Terms#

If you send messages in a ticket channel managed by Ticket King, you acknowledge the following:

  • Your messages and any uploaded files, images, or videos will be stored by Ticket King. While a ticket is open, your messages may be viewable in real time by authorized server staff through the web dashboard. After ticket closure, your messages are compiled into a transcript accessible on the Website. Depending on the server's configuration, images, videos, and other media you post in ticket channels may be transmitted to, processed by, and stored on third-party infrastructure as described in our Privacy Policy.
  • Transcripts are viewable by the ticket creator and authorized server staff members as configured by the server administrator.
  • You may request deletion of your data at any time by emailing [email protected] with the subject line "Data Deletion Request" and including your Discord user ID. We aim to process deletion requests within 30 days. For full details on the deletion process, including any limitations, please see our Privacy Policy.
  • You are responsible for the content you submit and must not submit content that is illegal, infringes third-party rights, or violates Discord's Terms of Service or Community Guidelines.
  • You may block or mute the Bot within Discord at any time. Ticket King does not retaliate against or penalize users who choose to block the Bot or opt out of interacting with ticket channels.

6. Account Security and Discord Account Dependency#

Account Security: Your access to the Service is authenticated through Discord OAuth. You are solely responsible for maintaining the security of your Discord account, including your login credentials and any authorized sessions. Ticket King is not liable for any unauthorized access to your data or the Service resulting from the compromise of your Discord account or credentials. You must notify us promptly if you believe your account has been accessed without authorization.

Discord Account Dependency: Your use of the Service, including any active premium subscription, is tied to your Discord account. If your Discord account is suspended, disabled, or terminated by Discord for any reason, your access to the Service will also be affected. We are not responsible for any loss of access or functionality resulting from actions taken by Discord against your account. Premium subscriptions will not be paused, refunded, or transferred in the event of a Discord account suspension or termination, except as may be required by applicable law.

7. Content License Grant#

By sending messages or uploading files in a ticket channel managed by Ticket King, or by uploading images directly through the Website (such as custom bot avatars and banners), you grant Ticket King a limited, non-exclusive, worldwide, royalty-free, sublicensable (solely to our service providers for the purpose of operating the Service) license to store, reproduce, transmit, and display your messages and uploaded files solely for the purpose of providing the Service, including real-time ticket message display on the web dashboard, the transcript service, and the display of customization assets. This license:

  • Is limited to the purpose of operating and providing the ticket management features of the Service, including real-time message display and transcript generation
  • Does not transfer ownership of your content — you retain all intellectual property rights in your content
  • Persists for the duration of data retention and terminates upon deletion of your data
  • Is revocable through the data deletion process described in our Privacy Policy
  • Applies to messages, images, videos, and any other files uploaded within ticket channels managed by the Bot, as well as images uploaded directly through the Website

8. Transcript Disclaimer and Retention#

Ticket transcripts are generated on a best-effort basis. Transcripts may not capture every message or attachment, including messages deleted before the Bot processes them, content sent during service outages or rate-limited periods, or certain message types not supported by the Bot. Ticket King is not liable for incomplete, missing, or inaccurate transcript data. Transcripts should not be relied upon as the sole record of any communication.

Meaning of Retention Descriptions: Where our Privacy Policy, marketing materials, feature descriptions, dashboard surfaces, or other communications describe transcripts as being retained "indefinitely," for the "lifetime" of the Service, as a "permanent" record, "forever," "with no expiration date," "long-term," or words of similar effect, those descriptions reflect our current operating intention to retain transcript data until deletion is requested by an authorized party or until deletion occurs under this Section or applicable law. Such descriptions are not contractual guarantees of perpetual storage, warranties of availability for any specific duration, or commitments that transcripts will survive changes to the Service, our infrastructure, or our business, and this Section governs in the event of any conflict between those descriptions and these Terms.

Reservation of Rights: We reserve the right, at our sole discretion and without liability, to: (a) delete, archive, or compress transcript data associated with Discord servers from which the Bot has been removed or that have been inactive for an extended period; (b) impose reasonable per-server, per-account, or per-tier storage, retention, or file-size limits, including differentiated limits for free and premium tiers; (c) migrate, re-encode, or reformat stored transcripts and attachments for operational, security, or cost reasons; (d) delete transcript data as required to comply with a request from a data subject, server administrator, applicable law, court order, or the terms of any third-party platform on which the Service depends (including Discord); and (e) modify the retention practices described in this Section or in our Privacy Policy on a prospective basis, subject to the notice requirements in Section 24.

Your Responsibility: As stated in Section 3, the Service should not be relied upon as the sole repository for any data whose preservation is important to you. Where long-term retention of transcript data is material to you or your community, you are responsible for exporting and independently retaining that data.

9. Intellectual Property#

All materials and content on Ticket King's Website and within the Service, including but not limited to text, graphics, logos, brand marks, images, photographs, illustrations, icons, animations, visual designs, user interface designs, page layouts, page structures, color schemes, typography, iconography, software, source code, object code, HTML, CSS, JavaScript, and all other code and markup are the property of Ticket King or its content suppliers and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

The overall look and feel of the Website and the Service, including the arrangement and selection of visual elements, the combination of colors, typography, page layout, graphic design, and the overall visual impression conveyed by the Website (collectively, the "Trade Dress"), constitutes the proprietary trade dress of Ticket King and is protected under applicable trade dress and unfair competition laws.

Any use of these materials, including reproduction, modification, distribution, republication, display, transmission, or creation of derivative works, without the prior written permission of Ticket King is strictly prohibited. You may not copy, imitate, or use any of Ticket King's intellectual property, including its Trade Dress, in any manner that is likely to cause confusion, deceive consumers, or misrepresent any affiliation with or endorsement by Ticket King.

Accessing, viewing, or using the Website or the Service does not grant you any ownership interest in, or any license or right to use, reproduce, or distribute, any of Ticket King's intellectual property, except for the limited use license expressly granted in Section 10 of these Terms. All rights not expressly granted herein are reserved by Ticket King.

This section does not apply to user-generated content submitted through ticket channels, which remains the property of its respective authors as described in Section 7.

10. Use License#

You are granted a temporary license to access and use the Service for personal or internal business purposes. Under this license, you may not:

  • modify or copy the materials on the Website except as necessary to use the Service;
  • use the materials for any commercial purpose unrelated to the Service or for any public display;
  • attempt to reverse engineer any software contained in the Service;
  • remove any copyright or other proprietary notations from the materials;
  • transfer the materials to another person or mirror the materials on any other server;
  • use any automated means, including bots, scrapers, crawlers, spiders, or other automated tools, to access, copy, download, index, or reproduce any content, materials, designs, or other assets from the Website or the Service;
  • create derivative works based on or inspired by the Website's designs, visual elements, layouts, or content;
  • reproduce, imitate, or use the Website's visual design, user interface, layout, color scheme, typography, iconography, or overall aesthetic as a template, reference, or basis for any other product, service, or website, whether competing or otherwise;
  • capture screenshots, screen recordings, or other reproductions of the Website's design or interface for any commercial purpose, competitive analysis, or to create substantially similar works; or
  • use any of the Website's creative assets, including images, illustrations, icons, graphics, or animations, outside of the Service or in any context not expressly authorized by these Terms.

Ticket King reserves the right to terminate this license for any violations of these restrictions. Upon termination, your access rights will also be terminated and you must destroy any downloaded materials in your possession.

11. Website Design and Creative Works Protection#

The visual design, creative works, and overall aesthetic of the Website and the Service represent significant original creative effort and investment by Ticket King. Ticket King claims and reserves all intellectual property rights in the Website's unique visual identity, including its Trade Dress as defined in Section 9.

Protected Elements: The following elements of the Website and the Service are proprietary to Ticket King and are expressly protected under these Terms, applicable copyright law, trade dress law, and other intellectual property laws:

  • Page layouts, page structures, navigation patterns, and the arrangement of visual elements
  • Color palettes, color schemes, gradients, and color combinations used throughout the Website
  • Typography choices, font pairings, text styling, and typographic hierarchy
  • Original illustrations, icons, iconography sets, graphics, and image assets
  • Animations, transitions, motion design, and interactive effects
  • User interface designs, component designs, form designs, and dashboard layouts
  • HTML structure, CSS stylesheets, JavaScript code, and all other front-end code and markup
  • Design patterns, design systems, and the overall visual language of the Website
  • Marketing materials, landing page designs, and promotional graphics
  • The overall look, feel, and visual impression of the Website and the Service as a whole

Prohibited Conduct: You may not, and you may not permit or authorize any third party to, copy, reproduce, imitate, replicate, reverse engineer, deconstruct, or create works substantially similar to any of the protected elements listed above, whether in whole or in part, for any purpose whatsoever. This prohibition applies regardless of the method used, including but not limited to manual recreation, use of automated tools, tracing, screen capture, code inspection, or any other means of reproduction.

Without limiting the foregoing, you specifically may not use any element of the Website's design, layout, visual identity, or creative works as a template, starting point, reference design, or source of inspiration for creating any competing product, service, or website, or for any product, service, or website that could reasonably be confused with or mistaken for Ticket King or its Service.

These protections apply to the protected elements both individually and as a collective whole, and regardless of whether any individual element may or may not be independently eligible for copyright registration. The selection, arrangement, coordination, and overall combination of these elements constitutes a copyrightable work and protectable trade dress owned by Ticket King.

Remedies: Any violation of this section constitutes a material breach of these Terms and may cause irreparable harm to Ticket King for which monetary damages alone would be inadequate. In addition to any other remedies available at law or in equity, Ticket King reserves the right to:

  • Seek immediate injunctive relief, including temporary restraining orders and preliminary and permanent injunctions, from any court of competent jurisdiction to prevent or restrain any actual or threatened violation of this section, without the necessity of posting any bond or other security
  • Pursue statutory damages under the United States Copyright Act (17 U.S.C. § 504) and any other applicable federal or state intellectual property statutes
  • Recover actual damages, lost profits, and disgorgement of any profits earned by the infringer as a result of the violation
  • Recover reasonable attorneys' fees, court costs, and other expenses incurred in enforcing its rights under this section
  • Pursue claims under the Digital Millennium Copyright Act (DMCA), the Lanham Act (15 U.S.C. § 1125), applicable state unfair competition laws, and any other applicable intellectual property laws
  • Immediately terminate your access to the Service without notice or refund

12. User Conduct#

You are responsible for your use of the Service and agree to use it only for lawful purposes and in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference. The Acceptable Use Policy sets out detailed rules on prohibited content and prohibited conduct, and how we enforce them. Without limiting that policy, you must not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to access or use the Service in a manner that violates the rights of any other person or entity
  • Engage in any conduct that is harmful to Ticket King, other users, or any other person or entity
  • Submit content that is unlawful, defamatory, obscene, or infringes the intellectual property rights of others, or that otherwise violates our Acceptable Use Policy
  • Attempt to disrupt, overload, or impair the operation of the Service
  • Use automated means to access the Service except through our published APIs
  • Use the Service in violation of any applicable export control, sanctions, or trade restriction laws, including those administered by the U.S. Office of Foreign Assets Control (OFAC)
  • Use the Service to collect, process, or store privacy-sensitive data from users, including but not limited to identity documents, payment card numbers, government identification numbers, or health information
  • Attempt to collect, solicit, or deceive other users into providing Discord passwords, login credentials, or authentication tokens through the Service
  • Impersonate Ticket King, Discord, or any other service in order to obtain credentials or sensitive information from users

13. Beta and Experimental Features#

Ticket King may from time to time offer features or functionality designated as "beta," "preview," or "experimental" ("Beta Features"). Beta Features are provided on an "as-is" and "as-available" basis without warranty of any kind.

  • Beta Features may be unstable, incomplete, or contain errors
  • We may modify, suspend, or discontinue any Beta Feature at any time without prior notice
  • Data associated with Beta Features may be deleted if the feature is discontinued
  • Beta Features are not covered by any service level commitments or availability guarantees

Your use of Beta Features is voluntary and at your own risk. To the maximum extent permitted by applicable law, Ticket King shall not be liable for any loss, damage, or disruption arising from the use of, or inability to use, any Beta Feature.

14. API Usage, Rate Limiting, and Feature Usage Limits#

Access to any Ticket King APIs, including the Bot's command interface, the web dashboard API, and any publicly documented endpoints, is subject to rate limits and usage restrictions. We reserve the right to impose, modify, or enforce rate limits at our sole discretion without prior notice.

Exceeding rate limits or engaging in excessive, automated, or abusive use of the API may result in temporary or permanent restriction of your access. We are not liable for any loss of functionality or data resulting from rate limiting or access restrictions applied to your account or server.

We do not guarantee the availability, stability, or backward compatibility of any API. APIs may be modified, deprecated, or removed at any time without notice. You assume all risk associated with reliance on any API functionality.

Feature Usage Limits: Where a feature is described in our marketing materials, feature comparison tables, or documentation as "unlimited" or without a stated numeric cap (for example, unlimited support tickets or unlimited ticket panels on premium plans), this reflects the absence of a pre-defined per-user quota in the ordinary course of use. It does not prevent us from applying reasonable technical, anti-abuse, fair-use, or stability-protection limits at our sole discretion, including temporarily or permanently restricting feature usage that we determine, in our reasonable judgment, to be abusive, automated, excessive relative to legitimate community use, or harmful to the stability, security, or cost structure of the Service or to other users. Such limits do not constitute a breach of any representation regarding "unlimited" features.

16. Disclaimer of Warranties#

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permissible by applicable law, Ticket King disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and completeness.

Ticket King does not warrant that: (a) the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components; (b) the results obtained from the use of the Service will be accurate or reliable; (c) the quality of any content, information, or other material obtained through the Service will meet your expectations; or (d) any errors in the Service will be corrected.

Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download or use of any such material.

17. Limitation of Liability#

To the maximum extent permitted by applicable law, Ticket King and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service, including without limitation any defamatory, offensive, or illegal conduct of other users or third parties; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any other matter relating to the Service.

In no event shall Ticket King's aggregate liability for all claims arising out of or relating to the Service or these Terms exceed the amount you paid to Ticket King in the twelve (12) months preceding the claim, or one hundred United States dollars (US $100), whichever is greater. This limitation applies to all causes of action in the aggregate, including without limitation breach of contract, breach of warranty, negligence, strict liability, and other torts.

The foregoing limitations of liability: (i) shall apply regardless of whether the damages arise from use or misuse of the Service, from inability to use the Service, or from the interruption, suspension, or termination of the Service; (ii) shall apply regardless of the theory of liability, whether based on warranty, contract, tort, strict liability, or any other legal theory; (iii) shall apply even if Ticket King has been advised of the possibility of such damages; and (iv) shall apply to the fullest extent permitted by applicable law. These limitations represent the sole and exclusive remedy available to you in connection with the Service.

You acknowledge and agree that the limitations of liability set forth in this section reflect a fair and reasonable allocation of risk between you and Ticket King, and that these limitations form an essential basis of the bargain between the parties. Without these limitations, Ticket King would not be able to provide the Service on an economically feasible basis.

The foregoing limitations shall not apply to: (a) liability arising from fraud or fraudulent misrepresentation; (b) liability for death or personal injury caused by negligence; or (c) any liability that cannot be excluded or limited under applicable mandatory law.

18. Indemnification#

You agree to indemnify, defend, and hold harmless Ticket King and its affiliates, officers, agents, employees, licensors, and suppliers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees, court costs, and settlement amounts) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms or any applicable law or regulation; (c) your violation of any rights of any third party, including any intellectual property, privacy, or publicity rights; (d) the content you submit, post, or transmit through the Service; (e) any claim by a third party arising from your use of the Service; (f) any regulatory investigation, inquiry, or enforcement action arising from your use of the Service or your processing of personal data through the Service; or (g) any claim by a data subject or individual whose personal data is processed through your use of the Service.

Ticket King shall have the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You shall not settle any claim without our prior written consent.

This section applies to the fullest extent permitted by applicable law. In jurisdictions where indemnification obligations imposed on consumers are restricted or prohibited by mandatory consumer protection law, this section shall apply only to the extent permitted.

19. Dispute Resolution#

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted on an individual basis, rather than in court. The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. If the AAA is unable or unwilling to administer the arbitration, the parties shall agree on an alternative arbitration provider, or either party may petition a court of competent jurisdiction to appoint an arbitrator. The arbitration shall be conducted in the State of Delaware, United States. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court.

Intellectual Property Exception: Notwithstanding the arbitration provisions above, Ticket King may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights, including but not limited to copyrights, trademarks, trade dress, trade secrets, and other proprietary rights as described in Sections 9, 10, and 11 of these Terms. This exception applies to claims for temporary restraining orders, preliminary injunctions, permanent injunctions, and any other equitable remedies, and such claims are not subject to the arbitration requirement. The filing of any such action shall not constitute a waiver of Ticket King's right to submit any other dispute to binding arbitration.

EU and UK Consumer Rights: If you are a consumer residing in the European Union or the United Kingdom, nothing in these Terms shall limit your rights under mandatory consumer protection laws in your jurisdiction, including your right to bring claims in the courts of your country of residence as provided by Regulation (EU) No 1215/2012 or applicable UK consumer protection legislation.

20. Governing Law#

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Subject to the dispute resolution provisions above, the state and federal courts located in the State of Delaware shall have exclusive jurisdiction over any disputes arising under these Terms.

21. Government and Law Enforcement Compliance#

Ticket King may access, preserve, and disclose your information, including account data, server configurations, ticket transcripts, and usage logs, if we believe in good faith that such action is reasonably necessary to: (a) comply with applicable law, regulation, legal process, or enforceable governmental request; (b) enforce these Terms, including investigation of potential violations; (c) detect, prevent, or otherwise address fraud, security, or technical issues; or (d) protect the rights, property, or safety of Ticket King, its users, or the public.

Where legally permitted, we will make reasonable efforts to notify affected users of such requests. However, we may be prohibited from providing notice in certain circumstances, including but not limited to emergency situations, court orders that include non-disclosure provisions, or where notice would jeopardize an investigation.

22. Termination#

We reserve the right to suspend or terminate your access to the Service and/or your account, without prior notice, if we determine in our sole discretion that you have misused the Service or violated any of these Terms. Misuse includes, but is not limited to, using the Service for any illegal or unauthorized purpose, attempting to access the Service in a manner that violates the rights of any other person or entity, or engaging in any conduct that is harmful to us or others. Upon termination, the provisions of these Terms that by their nature should survive (including, without limitation, intellectual property provisions, warranty disclaimers, indemnification, limitation of liability, and dispute resolution) shall continue to apply.

Termination Consequences: Upon termination for violation of these Terms, the following consequences apply:

  • All access to the Service, including the Bot, dashboard, and Website, will be immediately and permanently revoked.
  • Any active premium subscription will be cancelled immediately. No refunds will be issued for any unused portion of a subscription period where termination is due to a violation of these Terms.
  • Any attempt to circumvent or evade a termination through the use of alternate Discord accounts, servers, or other means constitutes a further violation and may result in additional enforcement measures, including but not limited to reporting to Discord Trust & Safety and, where applicable, relevant legal authorities.
  • Termination actions and the underlying basis for them are documented in our compliance records in accordance with our data retention policies and legal obligations.
  • Decisions to terminate access for violations of these Terms are made at our sole discretion and are final. Except as required by applicable law, we are not obligated to provide a formal appeal process. However, we will provide the reasons for any termination decision upon request.
  • Initiating a chargeback, payment dispute, or payment reversal without first making a good-faith effort to resolve the issue directly with us or our payment processor as described in our Pricing Details constitutes grounds for immediate termination under this section.

23. Discord API Data and Compliance#

The Service operates through Discord's API and is subject to Discord's Developer Terms of Service and Developer Policy. Data obtained through Discord's API ("API Data") is used solely for the stated functionality of the Service as described in Section 2 of these Terms and in accordance with Discord's requirements.

We do not sell, license, or commercialize API Data. We do not share API Data with advertising networks, data brokers, or any monetization services. We do not use message content or other API Data for artificial intelligence or machine learning model training purposes. We do not mine or scrape Discord data. We do not contact users outside of Discord using API Data without their explicit permission. We do not attempt to re-identify, de-anonymize, unscramble, unencrypt, or reverse hash any data obtained through Discord's API. We do not attempt to derive or infer information about users beyond what is directly provided through the API for the stated functionality of the Service. API Data is used strictly within the scope of the Service's stated functionality, is never used for any other purpose, and is not accessible to staff or moderators of the Ticket King support Discord server. Access to production data and systems is restricted exclusively to the sole operator, as described in our Security Policy and Data Processing Agreement.

Discord API Termination: Discord's Developer Terms of Service obligate developers to delete all cached and stored API Data if Discord terminates or revokes their API access. Although we do not anticipate any disruption to the Service, we include this disclosure for transparency regarding that obligation. In the unlikely event that Discord terminates or revokes Ticket King's access to the Discord API, we will comply with Discord's requirements regarding the deletion of API Data. This may require us to delete cached and stored data obtained through the API, including ticket messages, user identifiers, and server configuration data. We will notify affected users and server administrators if such an event occurs and provide information about the impact on the Service.

Cessation of Service: If Ticket King permanently ceases operations, we will provide reasonable advance notice to users and server administrators where possible and will delete all API Data obtained through Discord's API in accordance with Discord's Developer Terms of Service. We will make reasonable efforts to allow server administrators to export their data before deletion occurs.

Our use of API Data is governed by our Privacy Policy, and users retain all rights provided under Discord's Terms of Service.

24. Changes to These Terms#

We may update these Terms from time to time to reflect changes in our Service or applicable laws. We will notify you of material changes by posting the updated Terms on our Website and through an announcement in our official Discord server. For material changes that significantly affect your rights, we will provide at least 14 days' notice before the changes take effect. Your continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

25. Severability#

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

26. Entire Agreement#

These Terms, together with our Privacy Policy, Data Processing Agreement, and any other policies or agreements referenced herein, constitute the entire agreement between you and Ticket King with respect to the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

27. Force Majeure#

Ticket King shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, power outages, internet or telecommunications failures, Discord platform outages or API changes, cyberattacks, or any other force majeure event. During such events, Ticket King's obligations shall be suspended for the duration of the event.

28. Assignment#

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Ticket King. Ticket King may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. Any attempted assignment in violation of this section shall be void.

29. Waiver#

The failure of Ticket King to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Ticket King. No waiver shall be deemed a further or continuing waiver of such right or provision or any other right or provision.

30. Content Reporting and Automated Content Review#

If you encounter content on the Service, including within ticket transcripts displayed on the Website, that you believe violates these Terms, our Acceptable Use Policy, applicable law, or the rights of any person, you may report it by contacting us at [email protected] with the subject line "Content Report." We will review all reports and take appropriate action, which may include removing the content and/or suspending access. Content that may constitute child sexual abuse material (CSAM) or other illegal content will be reported to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC) as required by federal law.

Automated Content Review: Certain content submitted through the Service, in particular content submitted through the Website dashboard for the bot personalizer feature (including bot display names, bios, avatars, and banners), is automatically reviewed for compliance with our Acceptable Use Policy. This review is performed using our systems together with a third-party content-moderation provider engaged as a sub-processor under our Data Processing Agreement. By submitting content through the Service you consent to this review. Automated review may result in automatic denial of a submission, immediate removal of the submitted content, a permanent ban from the affected feature, and, in the case of apparent CSAM, a report to NCMEC as described above. You may contest an automated decision by following the appeal process set out in Section 7 of our Acceptable Use Policy.

31. Refund Policy#

Refund Exclusions: Notwithstanding any refund policy, no refunds will be issued in the following circumstances:

  • Your access to the Service has been terminated due to a violation of these Terms. Violation-based terminations result in immediate cancellation of your subscription with no refund for any unused portion of the billing period.
  • Your Discord account has been suspended, disabled, or terminated by Discord. Because your subscription is tied to your Discord account and server, we cannot provide refunds, credits, or subscription transfers if Discord takes action against your account.
  • Service interruptions caused by third-party platform outages (including Discord), force majeure events, or scheduled maintenance.

32. Assumption of Risk#

You acknowledge that no system is completely secure and that there are inherent risks associated with using any internet-based service, including the potential for unauthorized access to your data, data loss, service interruptions, and other unforeseen issues. By using the Service, you assume all risks associated with your use of the Service, including any risks arising from the storage, display, or transmission of your data through the Service. You are solely responsible for evaluating the adequacy and suitability of the Service for your particular needs and for implementing appropriate safeguards, including maintaining independent backups of any data you consider critical.

33. No Responsibility for User Content#

Ticket King does not monitor, screen, edit, or control the content submitted by users through ticket channels, nor do we have any obligation to do so. We are not responsible for the accuracy, completeness, legality, or appropriateness of any content submitted by users. You acknowledge that you may be exposed to content that is inaccurate, offensive, or otherwise objectionable.

Ticket King shall not be liable for any content submitted by users, including any errors or omissions, or for any loss or damage of any kind incurred as a result of the use of any user content. Server administrators are solely responsible for establishing and enforcing content policies within their Discord servers.

34. Statute of Limitations#

You agree that any claim or cause of action arising out of or related to your use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise. This provision does not apply where prohibited by applicable law, including mandatory consumer protection laws in the European Union or the United Kingdom.

35. Electronic Communications#

By using the Service, you consent to receive electronic communications from Ticket King, including service announcements, administrative messages, and legal notices. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent to receive electronic communications applies to all interactions with the Service, and you may withdraw this consent only by ceasing to use the Service.
